Involves defending clients in cases classified as Felonies,Misdemeanours and Capital cases. The practice also extends to handling Traffic Offence as well as cases involving Sexual Offences. The Firm handles several pro bono criminal briefs as well.
Depending on the nature of the case, the rights of accused persons may have been grossly violated thus necessitating remedial action through the Constitutional Courts. The Firm advices the accused persons of their Rights and the steps necessary to be taken in order to safeguard those rights.
The Kenyan criminal Justice system is the accusatorial type as opposed to the Inquisitorial type and in this regard accused persons are presumed innocent until proven guilty. They therefore have rights that are Constitutionally protected just like any other.
With the promulgation of the Constitution of Kenya, 2010, even persons who are charged with Capital offences are now elligible for grant of Bail by the Courts.
